Diagnosis of asbestos in Soissons: understanding obligations before selling

Are you planning to sell an old house or apartment in a building built before 1997 in Soissons? Asbestos diagnosis is an essential part of the sales record when the building permit is prior to July 1, 1997.

This guide explains when to order the tracking, how to choose a qualified diagnostician, what documents to examine in condominium and what a positive result means, without confusing diagnosis before sale and identification before work.

Before July 1997Pre-July 1, 1997 building permit: asbestos condition to be expected in case of sale.
Certified operatorThe certification and independence of the professional must be verified for this mission.
DDTThe report shall be included in the technical diagnostic file communicated to the purchaser.
01 · Regulatory framework

When is asbestos diagnosis required to sell to Soissons?

The central criterion is neither the neighbourhood nor the appearance of the facade nor the visible presence of suspect materials: it is the date of the building permit the building sold.

In the case of a sale of a dwelling whose building permit was issued before 1 July 1997the owner must restore a condition indicating the presence or absence of materials and products containing asbestos. The document is part of the technical diagnostic file (DDT), transmitted to the purchaser during the promise of sale or, in his absence, during the authentic act.

In Soissons, apartments in old buildings, townhouses, bourgeois houses or houses that have undergone several transformations may be involved. But it would not be serious to say that a dwelling contains asbestos based solely on its age or architectural style.

Potentially affected

Construction permit issued prior to July 1, 1997: The requirement to provide the appropriate asbestos status for the transaction must be reviewed.

Much more recent

A building permit issued from 1 July 1997 does not fall under this pre-sale diagnostic requirement under that date, subject to an accurate analysis of the building and its possible extensions.

Not to be confused: the obligation to restore asbestos in a sale and the obligation to locate before certain works do not necessarily concern the same materials or the same research area. A sales diagnosis does not automatically replace a pre-work tracking.
02 · The choice of professional

Which diagnostic provider chooses to locate asbestos in Soissons?

The right reflex is to check the personal certification of the operator corresponding to the intervention, as well as his professional liability insurance and his independence. The mere existence of a real estate diagnostic company, a website or a SIRET number does not demonstrate the certification of the person performing the control.

Checking competence

Seeofficial directory of certified diagnosticians and control the asbestos competence and validity.

Describe the good accurately

Indicate the type of accommodation, address, date of permit if known, area, appendices and possible co-ownership status.

Request an explicit quote

Check the scope visited, any further analyses, the time frame for intervention and the delivery of a report that can be used for sale.

Consideration of the report received

Reread the identification of the property, the controlled premises, the visit limits, the conclusions, the recommendations and the identity of the diagnostic.

The rate for asbestos diagnosis is not regulated. It may vary depending on the building's configuration, accessibility, search perimeter and investigation requirements. Rather than automatically retain the lowest price, compare services for the same property and missions.

03 · The type of property

Individual house or condominium: what documents should you request?

The perimeter of the location and the documents to be consulted depend on the nature of the building. In the case of a condominium, the private parts and common areas should not be confused.

Single house

The seller shall cause the building concerned to be examined in accordance with the rules for the identification of asbestos before sale. The operator shall specify in his report the materials sought, the limits and the conclusions.

Condominium apartment

The seller must have the required information about his private lot. The asbestos dossier of private parts (DAPP) and the status of asbestos before sale must be understood according to their own purpose.

Common parts of the building

The trustee or syndicate of co-owners holds the asbestos technical file (ATD) applicable to the common parties. The seller must request information useful to the purchaser.

Why separate DAPP from pre-sale diagnosis?

DAPP is a regulatory record related to the management of private parts and certain materials that may contain asbestos. For sale, the asbestos state must comply with the specific requirements of the transaction; It is therefore not sufficient to assume that an old certificate of co-ownership necessarily covers all the elements to be examined.

The trustee intervenes for information concerning the common parts of the building, through the DTA and its summary sheet. The owner of a single apartment should not be asked to make the diagnosis of all the common areas himself.

Let's go. Before accepting an offer for an old apartment, consider collecting the lot file and the trustee's information. You can complete this preparation with our file on the measurement law Carrez in condominium.

04 · Understanding the report

What happens if the diagnosor detects asbestos?

A positive result does not in itself prohibit the sale of the property. The sale remains possible, provided the purchaser receives the required information. However, the report's recommendations, the condition of the materials, and any monitoring or intervention requirements should be considered.

Presence of asbestos identified

The report shall specify the materials concerned, their location when accessible, their condition and recommendations. The seller must not minimize or conceal this information.

Absence detected in perimeter

The conclusion concerns the perimeter and materials actually controlled. A formula « absence of asbestos » does not mean that no inaccessible material could ever contain it.

Depending on the materials identified and their conservation status, the professional may recommend periodic follow-up, further investigation or corrective action. For certain materials in the list The periodic assessment must be carried out within a maximum of three years. It would be wrong to automatically generalize this deadline to all asbestos-containing materials.

Do not make improvised samples. Drilling, sanding, breaking or cutting a potentially asbestos-rich material can lead to dangerous fibre exposure. Investigations and interventions requiring specific precautions should be entrusted to competent professionals, in accordance with applicable regulations.

Does the presence of asbestos require that asbestos be removed before sale?

Not systematically. The obligation to remove or contain depends on the material concerned, their condition, the results of investigations and the applicable regulations. The decision cannot be inferred from the reference only « asbestos present ». A seller must nevertheless communicate the findings of the report and the measures prescribed or undertaken.

For a sale to Soissons, the information must be presented accurately, without promising the future purchaser that the work will be simple or cost-free, and without automatically turning a technical finding into a percentage discount.

05 · Validity and preparation of sale

How long is the asbestos diagnosis valid?

Public Service states that the asbestos state has a period of validity Unlimited. This does not mean, however, that any old report must be reused without examination: the exact coverage of the diagnosis, the work done since then or the evolution of the housing configuration can justify a new check or a check with the diagnostic and notary.

Where work has changed the building since the previous report, it is recommended, inter alia, to consider whether materials that have become visible or accessible should be further investigated.

What to prepare before contacting the professional?

  • The date of the building permit, or the elements to trace it.
  • The exact address and consistency of the property: house, apartment, annexes, outbuildings.
  • Former asbestos reports, if any, retained and proof of work.
  • Useful condominium information, including identification of the trustee.
  • The possibilities of access to the premises and materials concerned, without dismounting elements at risk yourself.

The sales report must be incorporated into the DDT submitted to the purchaser. It does not replace the DPE or other controls payable by age, facility and condition of property.

06 · Frequently Asked Questions

Useful answers for sellers

Does a house built before 1997 necessarily contain asbestos?

No. The date of the building permit determines the obligation to produce a state of asbestos before sale, but it does not allow to conclude the presence of asbestos without investigation.

Does the seller have to pay for the asbestos diagnosis?

According to Public Service, the cost of the asbestos diagnosis at the time of sale is borne by the vendor owner. Its price is not regulated.

Does an apartment in Soissons also require a diagnosis of common areas?

For the condominiums concerned, the trustee or the syndicate of co-owners shall manage the asbestos technical file of the common parties. The seller of a lot must obtain the relevant information and produce the necessary documents concerning its lot.

Does the presence of asbestos prevent the signature of the sale?

No, not by herself. The buyer must be informed in accordance with the applicable rules; any monitoring or work required must be considered in accordance with the conclusions of the report.

Can we use this diagnosis to demolish a partition?

It must not be presumed. Asbestos identification prior to work may be necessary and meet separate requirements. It must be organised prior to work likely to disrupt materials.

Should an old asbestos diagnosis be repeated?

The validity of the principle is unlimited according to Public Service, but a new tracking can be advised after work or when the content of the old report does not adequately cover the current situation. Have the diagnosis and notary confirm the decision.
