Do you sell a house in Soissons, a condominium apartment or a property in Soissonnais? Before ordering a « diagnostic sanitation », a question must be asked: Is the housing connected to the public network or does it have its own facility?
The control, interlocutor and documents to be given to the buyer are not the same. This guide explains how to organise audits without confusing national obligations with local service rules.
The function of sanitation is to collect and treat wastewater from housing. Water « valves » come in particular from toilets; Water « grey » sinks, showers and household appliances. The methods of collection differ according to ownership.
Waste water is sent to the public network and treated by the collective service. The connection can be controlled; its compulsory nature at the time of sale depends on the law and requirements applicable to the sector.
The property uses a stand-alone facility, such as an all-water pit associated with a treatment device. In case of sale, a report of the public non-collective sanitation service is required.
Do not rely solely on the location of the property. An old house located in the city can have a particular configuration; Conversely, a house on the outskirts can be connected to the public network. A billing statement, work documents and remediation information clarify the situation.
In the general case, outside the territories covered by special provisions, the mayor may impose by order the control of the connection to the public network at the time of a sale. In the absence of an applicable order, such control is not always mandatory on the sole ground of the transaction.
Consultation of public information alone is not sufficient to establish that monitoring is required for all sales to Soissons. For a particular address, the seller must therefore request confirmation from the competent department and then inform the notary of the reply.
Where control is required or organised, it includes the quality of connection, the accessibility of certain equipment, the sealing of networks and the management of stormwater. The separation of wastewater and rainwater must be examined according to the type of network and the requirements of local regulations: a separative network is not organized as a unitary network.
Ask if a sales control is prescribed for the address of the property and what steps the local service plans.
Find, if you have them, connection plans, minutes and proof of work.
In case of obligation or voluntary request, ask the appropriate contact person and keep his report.
Contact the notary and the buyer with the relevant document, with any comments or prescriptions.
Non-compliance does not mechanically prohibit any sale. However, it must be brought to the attention of the parties; the requirements, deadlines and cost of the work must be analysed. In some cases, work is required by the sanitation service. A purchaser should not be promised that the connection is compliant without having verified the documents.
Where the control concerns the connection of the collective building, the co-ownership trustee is normally the person responsible for making it happen. The seller of an apartment will ask the trustee for the available items and communicate them to the notary, distinguishing the common parts from any equipment falling within his lot.
Where a dwelling is not connected to the public wastewater collection system and has a self-contained sanitation facility, the seller must provide a non-collective sanitation monitoring report established by the competent public service, SANC.
The document must date from less than three years after signature of the authentic instrument. An old report may be kept in the property's historical record, but it is not sufficient if it has exceeded that time limit for the proposed transaction.
The monitoring shall include the existence of the facility, its operation, maintenance, possible accessibility deficiencies and risks to health or the environment. Findings may identify anomalies or require corrective action. This control should not be equated with a general guarantee on all pipes in the house.
| Situation | Practical consequence before sale |
|---|---|
| SPANC report under 3 years old | Verify that it relates to the facility sold and attach it to the sales record. |
| Report too old or absent | Request a new check from the competent SANC before signing. |
| Non-compliant installation | Inform the purchaser, review the requirements and clarify the work to be carried out. |
| Work left to the purchaser | The negotiation must incorporate the situation: compliance work must, under the arrangements applicable to the sale, take place no later than one year after the authentic act. |
The owner seller can perform the work before the sale. It may also choose to sell as it is, provided that it informs the purchaser and clearly organizes the transmission of the obligations. If the conformity work is left to the purchaser, it must be carried out within the prescribed time limit, in principle one year after sale. The financing and the effect on the price must be discussed with the notary and incorporated unambiguously into the documents of the transaction.
Attention: the SPANC report is an official document of the competent department. Controls presented as equivalent should not be ordered from any private company without verifying the conditions for recognition of the report by the public service.

No, not in a single form. The SANC control is required for non-collective sanitation housing. For a property connected to the public network, the requirements applicable to its address must be checked, including the existence of an order requiring control at the time of sale.
Not to replace a SPANC regulatory report: this control is the responsibility of the competent public service, which shall provide it or cause it to be provided under the conditions laid down. For the collective, contact the public sanitation service responsible for the connection.
The document in the sales file must be less than three years after the signature of the authentic document. A frequency of periodic inspection of the different service does not cancel this particular rule for sale.
The sale may be considered subject to good information from the parties and compliance with applicable obligations. The works, their costs and their deadlines must be explicitly dealt with with with the notary.
Not necessarily. It can sell as it is after informing the buyer. The remaining compliance work must then be taken into account and, in the case of the sale of a non-compliant NCA facility, carried out no later than one year after the signature of the act.
